Terms of Service

1. Agreement Overview

These Terms of Service ("Terms") govern your use of the Timekeep platform available at old.timekeep.ph ("Service"). By creating an account or using the Service, you agree to be bound by these Terms.

Parties:

  • "Timekeep" refers to the operator of old.timekeep.ph
  • "You" or "User" refers to the individual or business entity using the Service

2. Definitions

  • "Account" means your registered Timekeep account and all associated data
  • "Service" means the Timekeep web application, including all features and functionality
  • "User" means any individual with access to an Account (admin, supervisor, or member)
  • "Employee" means an individual whose time, attendance, or payroll data is managed through the Service
  • "Employee Data" means all personal and employment information entered for Employees
  • "Subscription" means your paid or trial access to the Service

3. Eligibility

To use the Service, you must:

  • Be a Philippine-registered business or sole proprietor
  • Be of legal age (18 years or older)
  • Have valid business operations in the Philippines

4. Account Registration

  • You must provide accurate and complete information during registration
  • One Account per business entity
  • The admin User who creates the Account is responsible for all activity under that Account
  • You are responsible for maintaining the security of your login credentials

5. Service Description

Timekeep provides the following features for Philippine businesses:

  • Employee time tracking and attendance management
  • Work scheduling
  • Payroll computation with Philippine statutory deductions (SSS, PhilHealth, Pag-IBIG, withholding tax)
  • Kiosk-based clock-in with PIN and face verification
  • Employee self-service portal
  • Leave management

6. Subscription & Billing

  • New accounts receive a 30-day free trial with full access, no credit card required
  • After the trial, the Service is billed on a per-employee monthly basis
  • Billing is recurring based on your chosen plan and billing cycle
  • Your Account retains access to all features until the end of the current paid period

7. Refund Policy

Subscriptions are non-refundable. For full details, please see our Refund Policy.

8. User Responsibilities

As a User of the Service, you agree to:

  • Enter accurate Employee data and keep it up to date
  • Comply with Philippine labor laws, including DOLE regulations and the Labor Code of the Philippines
  • Use payroll computation features as a tool and verify results before processing actual payroll
  • Maintain the security of account credentials, PINs, and kiosk devices

9. Data Ownership

  • You retain full ownership of all data you enter into the Service
  • Timekeep processes your data solely to provide the Service and does not use it for any other purpose
  • Data export is available upon request at any time during your active Subscription

10. Acceptable Use

You must not:

  • Attempt unauthorized access to the Service or its infrastructure, or reverse engineer any part of it
  • Use automated tools to scrape, crawl, or extract data from the Service
  • Upload malicious content, including viruses, malware, or harmful code
  • Use the Service for any illegal purpose or in violation of applicable laws

11. Intellectual Property

  • Timekeep owns all rights to the platform, including its code, design, and trademarks
  • You retain ownership of all business data you enter into the Service
  • No license to Timekeep intellectual property is granted beyond the right to use the Service as intended

12. Service Availability

  • Timekeep makes reasonable efforts to maintain uptime but does not guarantee 100% availability
  • Scheduled maintenance will be announced with advance notice when possible
  • Timekeep is not liable for downtime caused by force majeure events, including natural disasters, power outages, or circumstances beyond our control

13. Limitation of Liability

  • Timekeep's total liability is limited to the fees you have paid in the preceding 12 months
  • Timekeep is not liable for any indirect, consequential, or incidental damages
  • The Service is provided "as is" for payroll computation assistance and is not a substitute for professional accounting or legal advice

14. Termination

  • Either party may terminate the Subscription with notice
  • Timekeep may suspend or terminate Accounts that violate these Terms
  • Upon termination, your data will remain available for export for 30 days
  • After the 30-day export window, your data may be permanently deleted

15. Governing Law

  • These Terms are governed by the laws of the Republic of the Philippines
  • Any disputes shall be resolved in the proper courts of Metro Manila
  • Timekeep complies with the Data Privacy Act of 2012 (Republic Act No. 10173)

16. Changes to Terms

  • Timekeep may modify these Terms with 30 days' notice sent to your registered email address
  • Continued use of the Service after the notice period constitutes acceptance of the updated Terms
  • Material changes will be highlighted in the notification
